Traider Coach Terms and Conditions
Beta Release Notice
Traider Coach is currently offered as a beta version to individual consumers for personal use. During the beta, the Platform, or certain features of the Platform, may be incomplete, unstable, subject to change, limited in availability, or affected by errors, delays, interruptions, data issues, integration issues, performance issues, or other limitations.
During the beta, Traider Coach is available only through the downloadable desktop application. The website and web-based platform are used for information and sign-up but are not available as a way to access and use the Platform during the beta; web-based access and any other access methods described in these Terms are planned for later releases. Where these Terms refer to the website or web-based platform as a way to access and use the Platform, that describes functionality that will apply only if and when it is made available to you.
Order-entry functionality and User-Directed Order Transmission are available during the beta. When you use them, you create the order instruction and the desktop application sends it directly from your device to the exchange, broker, trading venue, or platform you select for handling and execution. Traider Coach’s servers are not part of the order path: they do not receive, route, hold, or execute your orders, and become aware that an order occurred only afterwards, through read-only access to your connected account. Traider Coach does not select the destination, does not itself execute orders, and earns nothing from your orders or order flow (see Sections 6 and 17). To use these trading features you must already hold an account with a supported exchange or broker. Connections to exchanges or brokers use trade and read permissions only and never withdrawal or transfer permissions, Traider Coach does not take custody of your funds or assets, and Traider Coach does not store your trade-enabled API keys, which are held client-side or through your third-party broker or exchange connection.
You should not rely on beta functionality as your sole source of trading information, market data, risk management, account monitoring, strategy review, trading discipline, or decision support.
During the beta period, Traider Coach may modify, suspend, restrict, reset, remove, replace, discontinue, or change beta features, integrations, data sources, tools, modules, access methods, settings, or outputs, in accordance with Section 47 and applicable law. Beta data, settings, configurations, alerts, reports, simulator results, strategy experiments, education progress, behavioural insights, Platform Outputs, or other beta-related data may be reset, deleted, modified, unavailable, or not migrated to later versions of the Platform, subject to the Privacy Policy and applicable law.
Your use of the beta version remains subject to these Terms, the Risk Disclosure & No Financial Advice Notice, the Privacy Policy, the EULA where applicable, and any beta-specific notices, warnings, or acknowledgements presented to you. Nothing in this notice excludes, restricts or modifies any consumer guarantee or other mandatory right you have under the Australian Consumer Law and the ASIC Act, or under the law of your own country of residence, that cannot lawfully be excluded (see Section 14).
1. Important Notice
Please read these Terms and Conditions carefully before accessing or using Traider Coach.
Traider Coach is a trader coaching, analytics, education, simulation, behavioural-awareness, and performance-feedback software platform. It is designed to help users review and better understand aspects of their trading process, including execution quality, risk exposure, strategy consistency, behavioural patterns, education progress, simulator performance, and other trading-related activity.
Traider Coach does not provide financial advice, investment advice, trading advice, trade recommendations, trading signals, portfolio management, brokerage services, custody services, fiduciary services, tax advice, legal advice, psychological advice, medical advice, or therapeutic services.
Traider Coach does not tell you what to trade, when to trade, whether to buy, sell, hold, enter, exit, increase, reduce, or avoid any position, how much capital to allocate, how much to risk, or whether any asset, market, exchange, strategy, or trading product is suitable for you. Where the Platform suggests default settings (such as suggested risk levels), those suggestions are general defaults that you can accept or change; they are your choice and are not a recommendation tailored to you (see Section 22).
You remain solely responsible for all trading decisions, trading outcomes, account activity, exchange activity, risk management, legal compliance, tax obligations, and losses.
Trading involves substantial risk. You may lose some or all of your capital. Where leverage, margin, derivatives, futures, perpetual contracts, options, crypto-assets, digital assets, or other volatile products are used, losses may be amplified and may, depending on the product, exchange, and jurisdiction, exceed your initial deposit, collateral, margin, or account balance.
Traider Coach does not guarantee profits, improved trading performance, reduced losses, better decision-making, improved discipline, reduced risk, emotional control, successful strategy development, or any particular trading outcome.
By accessing or using Traider Coach, you acknowledge that you understand the nature and limits of the Platform, that Traider Coach does not provide financial advice or trade recommendations, that trading is high risk, and that you remain solely responsible for your own trading decisions and losses.
This Important Notice highlights key risks and limitations. It does not replace the rest of these Terms, the Risk Disclosure & No Financial Advice Notice, the Privacy Policy, the End User Licence Agreement where applicable, or any other applicable policies or agreements.
2. Definitions and Interpretation
In these Terms and Conditions, unless the context requires otherwise, the following terms have the meanings set out below.
“Account” means the account created by a User to access or use Traider Coach.
“API” means any application programming interface, connection method, integration, data connection, authentication method, or similar technical mechanism used to connect Traider Coach with an exchange, broker, Third-Party Provider, data provider, or other service.
“Analytics” means any data analysis, metrics, scores, calculations, reports, dashboards, summaries, observations, or other outputs generated or displayed by Traider Coach.
“Connected Exchange Account” means an exchange account, broker account, trading account, wallet, or other third-party account that a User connects or enables for use with Traider Coach. Connections use trade and read permissions only and never withdrawal or transfer permissions.
“Crypto-Assets” or “Digital Assets” means crypto-assets, cryptocurrencies, tokens, stablecoins, digital currencies, digital commodities, virtual assets, or other blockchain-based or digitally represented assets, whether or not legally classified as financial products, securities, commodities, payment instruments, or otherwise in any particular jurisdiction.
“Educational Content” means any lessons, tutorials, written materials, videos, exercises, examples, prompts, frameworks, explanations, courses, practice activities, or other educational materials made available through Traider Coach.
“Feedback” means any information, prompt, alert, observation, score, summary, suggestion, analysis, reflection point, behavioural indication, process review, or other output provided by Traider Coach. Feedback is provided for informational, educational, analytical, and process-review purposes only and does not constitute financial advice, investment advice, trading advice, a trading signal, or a trade recommendation.
“Market Monitor” means any feature that displays, filters, ranks, monitors, identifies, or alerts Users to market data, price movement, volatility, liquidity, volume changes, exchange data, broker data, asset conditions, or other market-related information. Market Monitor outputs are informational only and do not constitute trading signals, trade recommendations, financial advice, or investment advice.
“Order Instruction” means any instruction, request, input, amendment, cancellation, setting, or command relating to an order, trade, position, asset, product, market, exchange, broker, trading venue, or account that a User creates and submits through Traider Coach using the Platform’s order-entry functionality.
“Platform” means Traider Coach, including the web-based platform, website, downloadable software, desktop application, dashboards, tools, modules, analytics, alerts, simulator, education content, market-monitoring features, exchange-connection features, broker-connection features, order-entry features, User-Directed Order Transmission features, and any related services or functionality made available by Traider Coach.
“Platform Outputs” means any alert, notification, score, metric, dashboard, report, Analytics, Feedback, Risk Alert, Market Monitor output, Strategy Feedback, simulator result, backtest, education content, Trading Mindset Module output, behavioural insight, Suggested Level, order status, prompt, calculation, summary, or other output generated, displayed, or provided by Traider Coach.
“Risk Alerts” means any alert, warning, prompt, notification, indicator, score, metric, or other output relating to trading risk, exposure, account activity, position behaviour, leverage, margin, volatility, concentration, loss, drawdown, or similar matters. Risk Alerts are supplementary informational tools only and are not a substitute for a User’s own risk management.
“Restricted Public-Sector Body” means any government agency, public-sector body, regulator, law-enforcement body, military body, local government authority, municipal authority, state-owned entity, or similar public authority.
“Strategy Feedback” means any feedback, analysis, observation, report, score, prompt, or other output relating to a User’s trading strategy, execution consistency, rule adherence, process discipline, historical behaviour, or strategy experimentation. Strategy Feedback is not a recommendation to adopt, modify, abandon, continue, or rely on any particular trading strategy.
“Subscription” means a paid plan, pricing tier, or recurring access arrangement that allows a User to access certain features of Traider Coach.
“Suggested Levels” means default Daily Stop, Trade Stop, or similar risk-setting values that Traider Coach proposes as a neutral starting point based on the broad experience category you select during onboarding. Suggested Levels are general defaults, are not tailored to your personal circumstances, and are not a recommendation; you choose your own levels and can change them at any time (see Section 22).
“Terms” means these Terms and Conditions, together with any policies, notices, schedules, or additional terms incorporated by reference.
“Third-Party Provider” or “Third-Party Service” means any exchange, broker, trading venue, wallet provider, market-data provider, payment processor, app store, cloud provider, hosting provider, analytics provider, identity provider, communications provider, support provider, security provider, API provider, software provider, or other third-party service provider used in connection with Traider Coach.
“Trading Action” means buying, selling, holding, entering, exiting, increasing, reducing, hedging, maintaining, avoiding, amending, cancelling, or otherwise taking or not taking action in relation to any trade, order, position, asset, product, market, strategy, exchange, broker, trading venue, or account.
“Trading Data” means trade history, orders, positions, balances, exchange account data, broker account data, transaction records, market data, performance data, simulator data, strategy data, risk data, behavioural trading data, or other trading-related data processed, displayed, imported, generated, or analysed through Traider Coach.
“Trading Mindset Module” means any feature that provides behavioural-awareness prompts, trading mindset observations, discipline indicators, emotional-pattern indicators, impulsivity indicators, consistency observations, or similar trading-performance reflection tools. The Trading Mindset Module does not provide medical, psychological, psychiatric, therapeutic, counselling, diagnostic, or mental health advice.
“Trial” means any free, discounted, promotional, limited, or introductory access period offered by Traider Coach, including any 14-day trial period.
“User”, “you”, or “your” means the individual who accesses or uses Traider Coach. During the beta, Traider Coach is offered only to individual consumers for personal use; access by or on behalf of a business, organisation, trading team, employer, fund, institution, or other entity is not offered during the beta. Traider Coach is not available for access or use by or on behalf of a Restricted Public-Sector Body unless expressly permitted by Traider Coach in writing.
“User Data” means any data, content, information, settings, preferences, records, files, account details, connected-account data, Trading Data, support communications, or other information provided by or relating to a User.
“User-Directed Order Transmission” means functionality through which the desktop application sends a User-created Order Instruction directly from the User’s device to the exchange, broker, trading venue, or platform selected by the User for handling or execution. Traider Coach’s servers are not part of the order path and do not receive, route, hold, or execute the order; Traider Coach does not select the destination for the order and does not itself execute the order.
“we”, “us”, “our”, or “Traider Coach” means Traider Coach Pty Ltd, trading as Traider Coach, and where applicable its affiliates, officers, employees, contractors, agents, licensors, and service providers.
Interpretation
In these Terms, unless the context requires otherwise: (a) headings are for convenience only and do not affect interpretation; (b) the singular includes the plural and vice versa; (c) “including”, “such as”, “for example”, or similar expressions are illustrative and do not limit the words that follow; (d) a reference to a law or rule includes that law or rule as amended or replaced from time to time; (e) references to access or use of Traider Coach include access through any access method made available by Traider Coach; (f) references to trading include trading, investing, speculating, buying, selling, holding, entering, exiting, increasing, reducing, hedging, or otherwise dealing in any asset, product, market, instrument, or position; (g) references to Feedback, alerts, Analytics, monitoring, strategy, mindset, risk, Suggested Levels, market conditions, or similar language must be interpreted consistently with these Terms and do not imply regulated advice, recommendations, portfolio management, brokerage, custody, medical advice, psychological advice, or therapeutic services; (h) support for an exchange, broker, asset, product, market, integration, feature, order type, or data source does not mean that Traider Coach recommends, endorses, approves, verifies, or accepts responsibility for it; and (i) if there is any inconsistency between a general provision and a more specific provision, the more specific provision applies to the extent of the inconsistency, unless otherwise stated.
3. About Traider Coach
Traider Coach is a trading-performance, analytics, education, simulation, behavioural-awareness, coaching, order-entry, and user-directed order-transmission software platform.
The Platform is designed to help Users review, understand, and reflect on aspects of their trading process through analytics, feedback, education, simulation, behavioural reflection, trade-review tools, market-monitoring tools, exchange or broker connectivity, order-entry functionality, and User-Directed Order Transmission.
Depending on the User’s Subscription tier, access method, settings, supported exchanges, supported brokers, jurisdiction, and the availability of Third-Party Services, Traider Coach may include features such as near real-time trading feedback (where supported), execution-quality analysis, risk monitoring, Suggested Levels, Strategy Feedback, strategy experimentation tools, a Trading Mindset Module, simulator and practice tools, Educational Content, Market Monitor tools, exchange or broker connectivity, order-entry functionality, and User-Directed Order Transmission.
Certain Platform Outputs, including Strategy Feedback, Risk Alerts, Market Monitor outputs, Suggested Levels, prompts, rankings, observations, and automated insights, may be generated using your settings and/or Traider Coach’s internal analytical processes, models, benchmarks, review criteria, and monitoring logic.
Traider Coach does not provide financial advice, investment advice, trading advice, trade recommendations, trading signals, portfolio management, discretionary account management, custody, fiduciary services, tax advice, legal advice, psychological advice, medical advice, or therapeutic services. Platform Outputs are provided for informational, educational, analytical, behavioural-awareness, and process-review purposes only.
Feature availability may vary depending on Subscription tier, Trial status, access method, device, operating system, browser, your settings, supported exchanges, supported brokers, connected accounts, region, jurisdiction, regulatory requirements, Third-Party Services, data availability, API availability, and Platform version. Public-facing materials describe features that are currently available and must not represent a feature as available where it is not.
Traider Coach may add, modify, or discontinue features, integrations, modules, exchanges, brokers, data sources, or access methods where reasonably necessary (for example, for legal, security, technical, or third-party reasons). Where a change would materially and detrimentally affect a paid feature you rely on, the change-control, notice, and refund provisions in Section 47 apply.
Marketing materials, app-store descriptions, website content, onboarding screens, help materials, and other public-facing materials should be read consistently with this section and the rest of these Terms, and must not represent planned or unavailable features as currently available. If there is any inconsistency between marketing materials and these Terms, these Terms apply, and nothing in any marketing material limits your rights under the Australian Consumer Law or the ASIC Act.
4. Access Methods: Web Platform and Downloadable Software
These Terms apply to all access to and use of Traider Coach, regardless of how Traider Coach is accessed or used.
Traider Coach may be made available through one or more access methods, including the Traider Coach website, web-based platform, downloadable software, desktop applications, mobile applications if made available, integrations with supported exchanges, brokers, trading venues, data providers or other Third-Party Services, API-based connections, account dashboards, modules, alerts, reports, user interfaces, and any other access method made available by Traider Coach from time to time.
Unless separate terms expressly state otherwise, these Terms apply to all such access methods and to all currently available Traider Coach features, tools, modules, dashboards, integrations, order-entry functionality, User-Directed Order Transmission, Analytics, Feedback, alerts, Educational Content, simulator tools, and related services. The same no-financial-advice, trading-risk, user-responsibility, Subscription, billing, Trial, consumer-rights, data, privacy, intellectual-property, liability, warranty, suspension, termination, and dispute-resolution provisions apply across all access methods.
Some functionality may differ between access methods, depending on Subscription tier, Trial status, device, operating system, browser, software version, app version, settings, internet connection, connected exchange or broker, jurisdiction, regulatory requirements, Third-Party Service availability, data availability, and technical limitations.
If separate terms, policies, app-store terms, software-licence terms, or jurisdiction-specific terms apply to a particular access method or feature, those additional terms also apply. If there is an inconsistency, the more specific provision applicable to the relevant access method or feature will apply, unless applicable law or the relevant additional terms require otherwise.
5. Relationship Between Terms and the EULA
Traider Coach may be made available through downloadable software, desktop applications, or other locally installed software. Where you download, install, access, or use any Traider Coach downloadable software, your use of that software may also be governed by a separate End User Licence Agreement (EULA).
These Terms govern the broader Traider Coach service relationship, including Accounts, Subscriptions, Trials, billing, platform services, exchange and broker connections, order-entry functionality, User-Directed Order Transmission, API connections, data, privacy, risk disclosures, no-financial-advice provisions, trading-risk provisions, disclaimers, limitations of liability, user responsibilities, consumer rights, suspension, termination, and dispute resolution. The EULA governs the licence to download, install, access, and use the downloadable software, including software-licence rights, installation, local software use, software restrictions, permitted devices, updates, and similar matters.
During the beta, each Account and software licence is for one individual User for personal use. This does not permit Account sharing, unauthorised use by another person, or access outside the permitted scope.
If you download, install, access, or use any Traider Coach downloadable software, you must comply with both these Terms and the EULA. If there is any inconsistency between these Terms and the EULA, the EULA will generally apply to software-licence, installation, and local software-use matters, while these Terms will generally apply to the broader platform, commercial, data, risk, no-advice, consumer-rights, liability, and user-responsibility matters. Nothing in the EULA limits or overrides the no-financial-advice, trading-risk, no-guarantee, user-responsibility, data, privacy, consumer-guarantee, disclaimer, limitation-of-liability, suspension, termination, or dispute-resolution provisions in these Terms, and nothing in either document excludes rights that cannot lawfully be excluded.
6. Product Scope, Feature Boundaries, and Execution Status
This section clarifies the scope and boundaries of the Platform and distinguishes Traider Coach’s role from the role of any third-party exchange, broker, trading venue, market maker, liquidity provider, custodian, clearing firm, or execution provider.
Traider Coach allows Users to import, display, review, analyse, and monitor trading-related data from supported exchanges, brokers, trading venues, or third-party accounts. This may include Trading Data, account information, market data, orders, positions, balances, execution history, risk metrics, strategy information, simulator data, behavioural trading patterns, education progress, and other data or outputs made available through the Platform.
Where supported, Traider Coach allows Users to create, submit, amend, or cancel order instructions through the Platform. Any such order instruction is created by the User, and the desktop application sends it directly from the User’s device to the third-party exchange, broker, trading venue, or platform selected by the User for handling and execution. Traider Coach’s servers are not part of the order path and do not receive, route, hold, or execute the order; Traider Coach becomes aware that an order occurred only afterwards, through read-only access to the connected account. Traider Coach does not select the destination for a User’s order, does not provide smart order routing, discretionary routing, best-execution venue selection, discretionary account management, portfolio management, trade recommendations, or investment advice, does not itself execute trades, and earns nothing from a User’s orders or order flow. The User is responsible for selecting the relevant exchange, broker, trading venue, product, asset, market, order type, price, size, timing, risk level, and any amendment or cancellation instruction.
Orders are handled and executed by the relevant third-party exchange, broker, trading venue, market maker, liquidity provider, clearing firm, or execution provider, subject to that third party’s own terms, rules, systems, fees, availability, and regulatory obligations. Traider Coach is not an exchange, broker, market maker, counterparty, custodian, clearing firm, settlement system, or execution venue.
Traider Coach does not hold client funds, does not provide custody of User assets, and does not control User exchange accounts, broker accounts, wallets, or trading accounts. Any funds, assets, collateral, margin, open positions, orders, balances, withdrawals, deposits, liquidations, or account restrictions remain subject to the relevant third-party provider.
Exchange and broker connections use trade and read permissions only and never withdrawal or transfer permissions. Traider Coach does not take custody of your funds or assets and does not store your trade-enabled API keys, which are held client-side or through your third-party broker or exchange connection. You are responsible for understanding and controlling the permissions you grant in connection with any Connected Exchange Account, and you should grant only the minimum permissions necessary for order-entry and data access and must not grant withdrawal, transfer, or custody permissions. You remain responsible for reviewing, updating, disabling, or revoking permissions through the relevant exchange, broker, third-party account, or Traider Coach setting where applicable.
To the extent not caused by Traider Coach’s breach of these Terms or negligence, Traider Coach is not responsible for any action taken in a User’s exchange account, broker account, wallet, trading account, or third-party account as a result of User settings, third-party systems, API permissions, exchange rules, broker rules, market conditions, connectivity issues, or unauthorised access caused by User-side security failures. Nothing in this section limits liability that cannot be excluded under applicable law.
You remain responsible for all actions taken through or in connection with your Traider Coach Account and any Connected Exchange Account, including connecting or disconnecting accounts; granting, modifying, or revoking API or account permissions; creating, submitting, amending, or cancelling order instructions and selecting their destination and details; checking whether any order instruction has been received, accepted, rejected, cancelled, filled, partially filled, delayed, or duplicated by the relevant third party; monitoring order status, fills, positions, balances, margin, leverage, liquidation risk, fees, and account activity directly with the relevant third party; and complying with applicable laws, exchange rules, broker terms, and market-conduct requirements.
Traider Coach may add, remove, modify, suspend, restrict, or disable any data-import, analytics, monitoring, connection, order-entry, or order-transmission feature where reasonably necessary, subject to Section 47 (including its notice and refund provisions for material changes affecting paid features), any applicable Subscription terms, and applicable law. Nothing in these Terms should be interpreted as Traider Coach assuming responsibility for the execution, non-execution, timing, price, fill quality, settlement, clearing, custody, margin, liquidation, account status, or legal or regulatory treatment of any order, trade, asset, product, market, or third-party account.
7. Acceptance of Terms, EULA, and Platform Policies
By creating an Account, accessing or using Traider Coach, starting a Trial, purchasing or renewing a Subscription, downloading or installing any Traider Coach software, connecting an exchange, broker, wallet, trading account, or third-party account, or submitting order instructions, you agree to be bound by these Terms.
Traider Coach may require you to accept these Terms at one or more points in the user journey, including when creating an Account; before starting a Trial; before purchasing, renewing, upgrading, or changing a Subscription; before downloading, installing, or launching downloadable software; before using the web-based platform; before connecting an exchange, broker, wallet, trading account, or third-party account; before granting API or data permissions; before enabling order-entry, User-Directed Order Transmission, Risk Alerts, Market Monitor tools, strategy tools, simulator tools, or other features; before accessing beta, preview, or early-access functionality; before accepting material updates to these Terms or any related policies; and at any other point where Traider Coach reasonably requires acceptance.
Where Traider Coach provides downloadable software, you may also be required to accept the applicable EULA. Traider Coach may use affirmative acceptance methods, including checkboxes, buttons, clickwrap screens, onboarding acknowledgements, installation prompts, and checkout confirmations. Traider Coach may maintain records of acceptance (such as timestamps, account identifiers, version numbers, and acceptance screens) to demonstrate which terms, policies, notices, and disclosures applied when you accessed or used Traider Coach.
The following documents are incorporated into these Terms by reference to the extent they apply to your use of Traider Coach: the Privacy Policy; the Cookie Policy; the Risk Disclosure & No Financial Advice Notice; the EULA, where downloadable software is used; Subscription, Trial, billing, cancellation, renewal, and refund terms; jurisdiction-specific notices or addenda; feature-specific notices presented in the Platform; beta or early-access feature terms; and any other policies, notices, schedules, or supplemental terms expressly incorporated or presented to you.
If you do not agree to these Terms or any applicable policy, notice, disclosure, EULA, or supplemental term, you must not access or use the relevant part of Traider Coach.
Traider Coach may update these Terms or related policies from time to time. Changes are made in accordance with Section 47, which sets out how notice is given and, for material changes, your right to cancel and receive a pro-rata refund. During the beta, Traider Coach is offered to individual consumers only; access by or on behalf of an entity, or by or on behalf of a Restricted Public-Sector Body, is not offered unless Traider Coach expressly agrees in writing.
8. Eligibility and User Requirements
You may access or use Traider Coach only if you satisfy the eligibility requirements in these Terms and are legally permitted to use the Platform in your jurisdiction. During the beta, Traider Coach is available to individual consumers for personal use only.
By creating an Account, starting a Trial, purchasing a Subscription, accessing or using Traider Coach, or connecting a third-party account, you represent and warrant that you are at least 18 years old or the age of legal majority in your jurisdiction, whichever is higher; you have legal capacity to enter into these Terms; all information you provide is accurate, complete, current, and not misleading; and your use of Traider Coach will comply with all applicable laws, regulations, sanctions rules, tax rules, exchange rules, broker terms, market-conduct rules, and third-party terms.
You also represent and warrant that you are legally permitted to access and use Traider Coach, to connect any third-party account you connect, and to trade, hold, buy, sell, enter, exit, or otherwise deal in any asset, product, market, instrument, or position that you choose to access or trade through or in connection with Traider Coach.
You must not access or use Traider Coach if you are barred by applicable law, sanctions, exchange rules, broker terms, Third-Party Provider terms, or any previous suspension or termination by Traider Coach, or if access would be on behalf of a Restricted Public-Sector Body without Traider Coach’s written approval. Additional sanctions and compliance requirements are set out in Sections 16 and 32.
Traider Coach may refuse, restrict, suspend, or condition access to the Platform or any feature where it reasonably believes that eligibility, legal, regulatory, operational, security, financial-crime, market-abuse, or reputational concerns arise, and may require additional information, verification, declarations, or documentation before allowing or continuing access. Where Traider Coach restricts or terminates access other than for your breach or fault, the notice and pro-rata refund provisions in Section 41 apply.
You must promptly notify Traider Coach if you cease to satisfy any eligibility requirement, become subject to a legal or regulatory restriction, become located in a restricted jurisdiction, or become aware that your access to or use of Traider Coach may no longer be lawful or permitted. Eligibility to access Traider Coach does not mean that trading, any asset, any product, any exchange, any broker, any strategy, or any Platform feature is suitable, appropriate, lawful, or available for you.
9. Account Registration and Security
To access or use Traider Coach, you may be required to create an Account and provide registration information. You agree to provide accurate, complete, current, and non-misleading information when creating or updating your Account, and to keep your Account information up to date. Traider Coach may rely on the information associated with your Account to provide access, process payments, deliver notices, assess eligibility, manage security, support exchange and broker connections, and administer the Platform.
You are responsible for maintaining the confidentiality and security of your Account credentials, including your username, password, authentication methods, email account, device access, security codes, recovery methods, and multi-factor authentication tools. Where Traider Coach offers multi-factor authentication or other security features, you are responsible for enabling and maintaining them where appropriate. Traider Coach may require additional verification for certain Account actions, connections, or suspicious activity.
You are responsible for activity that occurs under your Account, except to the extent the activity is caused by Traider Coach’s breach of these Terms, Traider Coach’s negligence, or a failure of Traider Coach’s own systems or security. During the beta, each Account is for one individual User. You must not share your Account credentials with unauthorised persons, allow unauthorised access, sell or transfer your Account, use another person’s Account without permission, create Accounts using false information, create multiple Accounts to abuse Trials or limits, or bypass authentication, verification, fraud-prevention, or access-control measures.
You must promptly notify Traider Coach if you become aware of or suspect unauthorised access, credential compromise, suspicious Account activity, unauthorised API activity, settings changes, data access, or any other security incident. Traider Coach may suspend, restrict, lock, reset, disable, or require additional verification for any Account where it reasonably believes there may be unauthorised access, credential compromise, suspicious activity, misuse, fraud, abuse, or a security or legal risk; where this is done other than for your breach or fault, Section 41 applies.
To the extent not caused by Traider Coach’s breach of these Terms, negligence, or failure of its own systems or security, Traider Coach is not responsible for losses caused by your failure to maintain Account security, protect your devices, secure your email account, manage access permissions, revoke compromised API permissions, or notify Traider Coach promptly of suspected unauthorised access. Nothing in this section limits liability that cannot be excluded under applicable law. Traider Coach may implement account-recovery processes, but recovery may require verification, may not be immediate, and may be refused or delayed where Traider Coach cannot verify your identity, ownership, or eligibility, or where recovery may create legal, security, fraud, or operational risk.
10. Software Access, Updates, Compatibility, and Version Support
This section applies to practical software-access, compatibility, update, and version-support issues. It does not replace the EULA or any software-licence terms that apply to downloadable software.
You are responsible for ensuring that your device, hardware, operating system, browser, network connection, internet service, security tools, firewall settings, permissions, and local environment are compatible with Traider Coach and any related software, integrations, or Third-Party Services you use.
Traider Coach may publish or change minimum technical requirements from time to time and may require you to install updates, patches, upgrades, security fixes, or newer versions to continue accessing the Platform or certain features. Older versions may become unsupported, insecure, degraded, restricted, or disabled; Traider Coach is not required to support older versions indefinitely. Certain features may be available only through particular access methods, devices, operating systems, browsers, software versions, Subscription tiers, jurisdictions, supported exchanges, supported brokers, or integrations, and near real-time features may depend on device performance, software version, browser support, network availability, third-party availability, and exchange or broker API performance.
To the extent not caused by Traider Coach’s breach of these Terms or negligence, Traider Coach is not responsible for problems, losses, interruptions, delays, errors, failed connections, missed alerts, inaccurate outputs, data-sync issues, or other issues caused by user-controlled or unsupported environments. Nothing in this section limits liability that cannot be excluded under applicable law. Traider Coach may suspend, restrict, or disable access from unsupported devices, unsupported operating systems, outdated software versions, insecure environments, compromised accounts, or configurations that Traider Coach reasonably believes may create security, operational, legal, or data-integrity risk.
11. Local Device Security, Cached Data, and User Environment
When you access Traider Coach through downloadable software, a desktop application, a browser, a mobile device, or another local device, certain data may be stored, cached, processed, or temporarily retained on that device or within your local environment, including local settings, logs, cache files, temporary files, authentication tokens, session information, user preferences, downloaded content, diagnostics, crash reports, error data, device identifiers, or usage information. Further information is set out in the Privacy Policy.
You are responsible for protecting the security of any device, operating system, browser, email account, password manager, authentication method, network, cloud account, or local storage location that you use to access Traider Coach. You should keep your device, operating system, browser, security tools, authentication tools, and Traider Coach software up to date, use strong passwords, enable available security features where appropriate, avoid insecure shared or compromised devices and networks, and prevent unauthorised persons from accessing your device, browser session, downloaded software, Account, connected accounts, or authentication method.
To the extent not caused by Traider Coach’s breach of these Terms, negligence, or failure of its own systems or security, Traider Coach is not responsible for losses, data exposure, account misuse, unauthorised activity, failed alerts, or inaccurate outputs caused by compromised devices, malware, phishing, keyloggers, insecure networks, shared devices, unauthorised local access, user-side security failures, compromised email accounts, compromised authentication methods, or failure to maintain a secure local environment. Nothing in this section limits liability that cannot be excluded under applicable law.
Local storage, cache files, browser sessions, temporary files, logs, diagnostic data, crash reports, downloaded content, exported files, or other local data may remain on your device after logout, disconnection, cache clearing, software update, or uninstall, depending on your device, operating system, browser, software version, settings, and the technical design of the Platform. Logout, disconnection, or uninstall may not immediately delete all data stored in Traider Coach systems, third-party systems, backups, logs, or support records, as further described in the Privacy Policy. You should not rely on locally cached, delayed, stale, incomplete, or previously downloaded data when making trading decisions, reviewing risk, monitoring account activity, or assessing market conditions.
12. Cross-Platform Data Syncing and Feature Availability
Traider Coach may allow you to access your Account and certain Platform features through multiple access methods. Account data, connected exchange or broker data, Trading Data, Analytics, alerts, settings, simulator data, education progress, Market Monitor data, Strategy Feedback, Trading Mindset Module outputs, and other Platform data may sync across access methods, but syncing may be delayed, incomplete, interrupted, unavailable, or inconsistent.
Data shown in different access methods may temporarily differ because of latency, local cache, offline use, settings, software-version differences, exchange or broker API delays, market-data delays, system updates, maintenance, network issues, or third-party service issues. You should not rely on stale, cached, delayed, incomplete, or inconsistent data when making trading decisions, reviewing risk, monitoring positions, checking balances, or assessing market conditions, and you remain responsible for independently verifying important information through the relevant exchange, broker, trading venue, wallet, account provider, data provider, or other Third-Party Service where appropriate.
Features may vary depending on access method, Subscription tier, Trial status, device, browser, operating system, software version, settings, account permissions, exchange, broker, jurisdiction, regulatory requirements, beta status, API availability, data availability, or third-party service availability. Traider Coach may add, modify, restrict, suspend, remove, replace, rename, or discontinue features, integrations, data sources, connections, dashboards, Platform versions, or access methods where reasonably necessary, subject to Section 47, any applicable Subscription obligations, and applicable law. Traider Coach does not guarantee that all features will be available at all times, in all jurisdictions, through all access methods, on all devices, for all Users, or for all Subscription tiers.
13. Subscription, Trial, Billing, and Pricing Tiers
Traider Coach may be offered through free access, Trial access, or paid Subscription plans made available from time to time. Subscription fees are charged in United States dollars. Prices shown on the website are exclusive of applicable taxes; any applicable sales, goods-and-services, value-added, or similar taxes are added at checkout, so the total price you confirm and pay at checkout is inclusive of those taxes. The tax-inclusive total payable is shown to you before you complete your purchase. Any genuinely third-party charges you incur (such as bank, card, or foreign-exchange fees applied by your own provider) are separate and are not controlled by Traider Coach.
13.1 Trial Access
Traider Coach may offer a 14-day Trial to eligible Users to evaluate the Platform before purchasing a paid Subscription. Unless Traider Coach states otherwise, each User may only use one Trial, and Traider Coach may refuse, restrict, suspend, or cancel Trial access where it reasonably believes a User is attempting to abuse, repeat, share, transfer, or circumvent Trial eligibility rules.
The Trial does not require any payment details and does not automatically convert into a paid Subscription. You are not charged during or at the end of the Trial. When the Trial period ends, your Trial access simply ends, and you will only be charged if you separately choose to purchase a paid Subscription. Traider Coach will send you a reminder before the Trial ends so you know when it is due to expire. You can stop using the Trial at any time, and you can purchase a paid Subscription before or after the Trial ends if you choose to.
13.2 Subscription Plans and Pricing Tiers
Traider Coach may offer one or more individual-consumer Subscription plans or pricing tiers, which may include different levels of access, functionality, usage limits, exchange and broker connections, data-history limits, alert limits, simulator access, education content, analytics, reports, or support. Business, team, and institutional plans are not offered during the beta.
Traider Coach may change, add, remove, rename, or modify Subscription plans, pricing tiers, features, limits, or plan descriptions from time to time. Where a change is material or detrimental to a plan you currently pay for, including a price increase or removal of a paid feature, the notice, cancellation, and pro-rata refund provisions in Section 47 apply. Access to a feature in one plan does not guarantee that the feature will be available in another plan, in all jurisdictions, through all access methods, or on all supported exchanges, brokers, devices, or Platform versions.
13.3 Billing, Payment, and Renewal
Subscription fees may be charged monthly, annually, or on another billing cycle disclosed at the time of purchase. By purchasing a Subscription, you authorise Traider Coach or its third-party payment processor to charge the applicable fees, taxes, and other amounts disclosed to you using the payment method provided.
Subscriptions renew automatically at the end of each billing period until cancelled. Before each renewal, and before any price increase takes effect, Traider Coach will send you a reminder a reasonable time in advance that states the renewal date or the date the new price applies, the amount, and how to cancel. If you do not wish to renew, you may cancel at any time before the renewal date using the method described in Section 13.5. Fees are charged in the currency displayed at checkout. You are responsible for any genuinely third-party charges you incur, such as bank charges or foreign-exchange charges applied by your own provider.
If a payment fails, Traider Coach may retry the payment method, request updated payment details, suspend or downgrade access, or restrict Platform features until payment is received, and will give you a reasonable opportunity to update your payment details before suspending access.
13.4 Upgrades and Downgrades
You may be able to upgrade or downgrade your Subscription through your Account or by contacting support. An upgrade takes effect immediately unless stated otherwise, and you authorise Traider Coach or its payment processor to charge any applicable upgrade fee, price difference, prorated amount, or tax. A downgrade takes effect at the end of the current paid billing period unless applicable law requires otherwise; you retain access to your current plan until then. Downgrading may result in loss of access to certain features when it takes effect. This Section 13.4 does not limit any refund right you have under Section 13.6, Section 14, or applicable law.
13.5 Cancellation
You may cancel your Subscription at any time through a self-service cancellation method available in your Account or billing settings that is at least as simple and accessible as the process used to subscribe. Where you subscribed through a third-party app store or payment provider, cancellation may also be available through that provider. Cancellation stops future renewals. After cancellation, you retain access until the end of the current paid billing period, unless access is suspended or terminated under these Terms. Refunds are dealt with in Section 13.6, Section 14, and applicable law.
13.6 Refunds
Except as set out in this section, in Section 14, or as otherwise required by law or stated by Traider Coach, fees for a billing period that has already started are not refundable merely because you cancel, downgrade, stop using the Platform, or are dissatisfied with trading outcomes. However, Traider Coach will provide a pro-rata refund of pre-paid fees for the unused part of a billing period where Traider Coach terminates or suspends your access other than for your breach or fault (see Section 41), or where Traider Coach materially withdraws or reduces a paid feature you rely on during a period you have paid for (see Section 47).
Your rights under the Australian Consumer Law and the ASIC Act, including any right to a refund or other remedy for a failure to meet a consumer guarantee, are not excluded or limited by this section and prevail over anything inconsistent in it (see Section 14).
13.7 Invoices and Payment Processors
Traider Coach may issue invoices, receipts, or billing confirmations electronically. You are responsible for reviewing billing information and notifying Traider Coach promptly of any billing errors. Payments may be processed by Third-Party Providers, which may apply their own terms, privacy policies, payment methods, currency conversion, fees, chargeback processes, or dispute procedures.
14. Consumer Guarantees, Cooling-Off, Auto-Renewal, and Regional Subscription Rules
Your rights under Australian consumer law. If you are a consumer under the Australian Consumer Law (or the equivalent provisions of the ASIC Act), our services come with guarantees that cannot be excluded under that law, including a guarantee that services will be supplied with due care and skill. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under that law where it cannot lawfully be excluded. Where our liability for failing to comply with such a guarantee can be limited, it is limited as set out in Section 39. To the extent any disclaimer or limitation in these Terms would otherwise remove such rights, it does not apply to you. If you are a consumer under the law of another country, you retain in the same way any mandatory consumer-protection rights under that law that cannot lawfully be excluded.
Some Users may also have cooling-off rights, withdrawal rights, refund rights, cancellation rights, auto-renewal protections, or other mandatory legal protections under the laws of their jurisdiction. Nothing in these Terms excludes, restricts, modifies, or limits any consumer guarantee, statutory right, cooling-off right, withdrawal right, refund right, cancellation right, or other mandatory legal protection that cannot lawfully be excluded, restricted, modified, or limited.
Where required by applicable law, Traider Coach will provide relevant information about Trial terms; Subscription fees; billing cycles; automatic renewal; cancellation methods; renewal and price-change notices; refund rights; cooling-off or withdrawal rights; digital-service commencement; payment authorisation; and any other legally required consumer or subscription disclosures. If applicable law gives you a right to cancel, withdraw from, or receive a refund for a Subscription, Trial, digital service, or other purchase, that right applies despite anything else in these Terms.
Where permitted by law, certain cooling-off, withdrawal, or refund rights may not apply, or may be lost, once digital services, downloadable software, online access, or paid Subscription features have been made available or used with your consent. Any such exception applies only to the extent permitted by applicable law. The Trial does not automatically convert into a paid Subscription. If a Subscription renews automatically, Traider Coach will provide the disclosures, notices, consents, cancellation methods, and reminders required by applicable law and by Section 13.3.
You are responsible for reviewing the Subscription, Trial, billing, renewal, cancellation, and refund terms presented at checkout, in your Account, or by any payment or app-store provider used to access Traider Coach. If you purchase through a third-party payment provider or app store, your cancellation, refund, renewal, and payment processes may also be governed by that third party’s terms. Traider Coach may provide additional jurisdiction-specific terms, notices, or disclosures, and where any such term or mandatory legal protection conflicts with these Terms, the mandatory protection applies to the extent required by applicable law.
15. Permitted Use and User Conduct
You may use Traider Coach only for lawful purposes, in accordance with these Terms, and within the limits of your Subscription tier, Trial access, Account permissions, access method, jurisdiction, and any applicable feature-specific restrictions. During the beta, you may use Traider Coach for your own personal use only.
You must not use Traider Coach to infringe third-party rights; scrape, harvest, extract, index, crawl, download, monitor, or collect data except as expressly permitted; reverse engineer, decompile, disassemble, modify, adapt, translate, reproduce, or create derivative works from, or attempt to discover the source code, models, workflows, prompts, scoring systems, analytics logic, or trade-review frameworks of, Traider Coach except where applicable law permits this despite the restriction; resell, sublicense, commercialise, or provide unauthorised access to Traider Coach; share or misuse credentials, tokens, API connections, or access rights; bypass usage limits, Trial limits, Subscription limits, security controls, geographic restrictions, or technical limitations; or remove proprietary notices, risk warnings, disclaimers, legal notices, security notices, or Platform warnings.
You must not transmit malicious code or harmful material; attempt to gain unauthorised access to Traider Coach, another User’s Account, connected accounts, APIs, systems, networks, databases, servers, infrastructure, or data; probe, scan, test, attack, overload, disrupt, degrade, disable, interfere with, or circumvent the security, availability, integrity, performance, or operation of Traider Coach or any related system; use bots, scripts, scraping tools, credential-stuffing tools, denial-of-service tools, or similar methods without Traider Coach’s express written approval; connect any exchange, broker, wallet, trading account, or third-party account that you do not own or are not authorised to use; misrepresent your identity, location, authority, or eligibility; or use Traider Coach from a prohibited or restricted jurisdiction. Financial-crime, market-abuse, and sanctions matters are addressed in Section 16.
Traider Coach may monitor Platform usage, investigate suspected misuse, enforce technical controls, impose rate limits, restrict features, require additional verification, suspend or terminate Accounts, disconnect integrations, block access, remove content, or revoke access tokens where it reasonably believes that these Terms have been breached or that Platform use creates legal, regulatory, security, operational, financial-crime, market-abuse, or technical risk. Where action is taken other than for your breach or fault, Section 41 applies. You agree to cooperate with Traider Coach in any reasonable investigation of suspected misuse, security incidents, unauthorised access, unlawful activity, market abuse, payment abuse, Trial abuse, Subscription abuse, or breach of these Terms.
16. Sanctions, Fraud, Market Abuse, and Prohibited Activity
You must not access or use Traider Coach if doing so would violate any applicable sanctions, export-control, trade-restriction, anti-money laundering, counter-terrorist financing, anti-fraud, market-conduct, exchange, broker, or other legal or regulatory requirement, or if you are subject to sanctions, asset freezes, export controls, or similar restrictions, or located in or accessing Traider Coach from a country or region where access is prohibited, restricted, or unsupported.
You must not use Traider Coach for money laundering, terrorist financing, sanctions evasion, fraud, market manipulation, wash trading, spoofing, layering, pump-and-dump activity, insider trading, front-running, abusive or unauthorised trading, identity theft, account takeover, phishing, credential theft, use of stolen credentials, or any other unlawful, abusive, deceptive, manipulative, or prohibited activity. You must not connect, access, or use any account, API credential, access token, payment method, or identity document unless you own it or are properly authorised to use it.
Traider Coach may restrict, suspend, block, delay, investigate, or refuse access to any Account, Subscription, Trial, feature, connection, API connection, payment, or other Platform activity where it reasonably believes the activity may involve unlawful conduct, sanctions risk, fraud, market abuse, financial crime, unauthorised access, account misuse, security risk, exchange-rule or broker-rule violations, or breach of these Terms. Traider Coach may request information or documentation to verify identity, location, ownership, authority, eligibility, or sanctions status where reasonably necessary for legal, regulatory, security, fraud-prevention, or risk-management purposes, and may report and cooperate with regulators, law-enforcement agencies, courts, exchanges, brokers, payment providers, banks, app stores, and other relevant third parties where permitted or required by law.
Because of the legal, regulatory, security, fraud-prevention, financial-crime, or market-integrity risks involved, Traider Coach may act immediately and without advance notice where it reasonably believes that is necessary to address those risks; it will give you notice as soon as reasonably practicable afterwards. You are responsible for any losses, costs, liabilities, penalties, claims, account restrictions, exchange or broker actions, or regulatory consequences arising from your unlawful, unauthorised, abusive, manipulative, fraudulent, sanctioned, or prohibited use of Traider Coach, except to the extent liability cannot be allocated to you under applicable law.
17. Exchange Connection and API Terms
Traider Coach allows Users to connect supported exchange accounts, broker accounts, wallets, trading accounts, or other third-party accounts to the Platform for analytics, monitoring, feedback, trade-review, order-entry, and User-Directed Order Transmission purposes. Connections use trade and read permissions only and never withdrawal or transfer permissions.
Traider Coach is not an exchange, broker, custodian, clearing firm, execution venue, market maker, liquidity provider, wallet provider, or counterparty. You remain bound by the terms, policies, fees, rules, restrictions, and risk disclosures of each exchange, broker, wallet provider, trading venue, or other third-party service you use or connect.
Where supported, Traider Coach allows Users to create, submit, amend, or cancel order instructions through the Platform for transmission to the User-selected exchange, broker, trading venue, or third-party platform for execution. Traider Coach does not select the destination for a User’s order unless expressly stated otherwise, does not itself execute trades, and does not guarantee that any order instruction will be received, accepted, executed, amended, cancelled, filled, or settled by the relevant third party. Users are solely responsible for all order instructions submitted through Traider Coach, including the exchange, broker, trading venue, asset, market, order type, order side, quantity, price, timing, risk level, destination, and any amendment or cancellation instruction. Traider Coach does not hold client funds, does not provide custody of User assets, and does not store trade-enabled API keys, which are held client-side or through the User’s third-party broker or exchange connection. Connections never use withdrawal or transfer permissions. Users should grant only the minimum permissions necessary for order-entry and data access, must not grant withdrawal, transfer, or custody permissions, and are responsible for reviewing, managing, restricting, disabling, or revoking permissions through the relevant exchange, broker, wallet provider, or third-party account.
To the extent not caused by Traider Coach’s breach of these Terms or negligence, Traider Coach is not responsible for losses, delays, errors, failed orders, duplicate orders, rejected orders, partial fills, missed cancellations, failed amendments, incorrect prices, slippage, latency, liquidation events, margin issues, account restrictions, fees, delistings, insolvency, withdrawal restrictions, cyber incidents, data errors, API outages, or service interruptions caused by any exchange, broker, wallet provider, trading venue, market-data provider, API provider, liquidity provider, payment provider, cloud provider, or other third-party service. Nothing in this section limits liability that cannot be excluded under applicable law.
Connected-account data may be delayed, incomplete, inaccurate, unavailable, duplicated, corrupted, or inconsistent with the data shown directly by the relevant third party. You should independently verify important information directly with the relevant third party, including order status, fills, cancelled or rejected orders, open positions, balances, margin, leverage, liquidation risk, fees, deposits, withdrawals, and account restrictions. Traider Coach may add, remove, suspend, restrict, modify, disable, or discontinue any connection, API connection, order-entry feature, order-transmission feature, market-data source, or integration where reasonably necessary, subject to Section 47, any applicable Subscription obligations, and applicable law. Support for any third party, asset, market, order type, data source, API, or integration does not mean that Traider Coach recommends, endorses, approves, verifies, guarantees, or accepts responsibility for it.
18. Traider Coach Does Not Provide Financial Advice
Traider Coach does not provide financial advice, investment advice, trading advice, trade recommendations, trading signals, personal recommendations, portfolio management, discretionary account management, brokerage, custody, fiduciary services, tax advice, legal advice, psychological advice, medical advice, or therapeutic services. Traider Coach does not recommend any Trading Action.
Platform Outputs are provided for informational, educational, analytical, behavioural-awareness, operational, and process-review purposes only. They are not financial advice, investment advice, trading advice, trade recommendations, trading signals, psychological advice, medical advice, diagnosis, therapy, or professional advice. Traider Coach does not assess whether any trade, asset, product, market, strategy, exchange, broker, trading venue, position, order type, risk level, or Platform feature is suitable, appropriate, advisable, lawful, or beneficial for you.
Where the Platform offers Suggested Levels or other default settings, those are general defaults you can accept or change; they are your choice and are not a personal recommendation (see Section 22). Traider Coach may provide tools that help you review trading activity, execution quality, risk exposure, strategy consistency, behavioural patterns, simulator performance, education progress, market conditions, and connected-account data. These tools are not advice and should not be interpreted as instructions to take or avoid any Trading Action.
Any decision to place, amend, cancel, avoid, increase, reduce, hedge, or close an order or position is made by you alone. You remain solely responsible for your trading decisions, account activity, risk management, compliance obligations, and losses. You should conduct your own independent analysis before making any trading decision and, where appropriate, seek advice from a qualified financial, legal, tax, psychological, medical, or other professional adviser. No communication, content, feature, support response, marketing material, educational material, or Platform interaction from Traider Coach should be treated as creating an advisory, fiduciary, brokerage, portfolio-management, custody, agency, medical, psychological, therapeutic, or professional-client relationship.
19. User Responsibility for Trading Decisions
You are solely responsible for all trading decisions, trading outcomes, account activity, risk management, and losses. This includes deciding whether to trade at all, what assets or markets to trade, which exchanges or brokers to use, what Trading Action to take or avoid, how much capital to allocate or risk, whether to use leverage or high-risk products, and whether to amend, cancel, maintain, or close any order or position.

You are responsible for complying with all financial, legal, regulatory, tax, sanctions, exchange, broker, market-conduct, and reporting obligations that apply to you and your trading activity.
20. General Trading Risk
Trading involves substantial risk. You may lose some or all of your capital. Market prices can move quickly and unpredictably, and trading outcomes may be affected by volatility, liquidity, spreads, fees, slippage, latency, outages, market gaps, news events, economic events, regulatory actions, technical failures, data errors, and exchange or broker restrictions.
Where leverage, margin, derivatives, futures, perpetual contracts, options, contracts for difference, short selling, or similar products are used, losses may be amplified and may, depending on the product, exchange, broker, and jurisdiction, exceed your initial deposit, collateral, margin, or account balance. Past performance, historical results, examples, simulations, backtests, strategy tests, case studies, testimonials, screenshots, or educational materials are not reliable indicators of future performance, and no trading strategy, risk-management method, alert, simulator result, backtest, education module, analytics output, market-monitoring tool, or behavioural insight can eliminate trading risk or guarantee profitable results.
You should trade only with capital you can afford to lose, and should carefully consider whether trading, any asset, any product, any exchange, any broker, any strategy, or any Platform feature is appropriate for your circumstances, experience, objectives, risk tolerance, financial position, and legal obligations. You remain solely responsible for understanding and accepting the risks of any trading activity you choose to undertake.
21. Crypto-Asset and Digital Asset Risk
Crypto-assets and digital assets can be highly volatile, speculative, illiquid, and unpredictable. Prices may move rapidly and substantially, including over very short periods. They may be affected by market sentiment, liquidity, exchange activity, regulatory developments, protocol changes, technological failures, fraud, scams, cyber incidents, market manipulation, concentration of ownership, governance decisions, and other factors that may be difficult or impossible to predict.
The legal and regulatory treatment of crypto-assets, digital assets, tokens, exchanges, wallets, custody arrangements, staking, lending, derivatives, and stablecoins varies by jurisdiction and may change quickly, and an asset may become restricted, prohibited, delisted, or subject to additional requirements. Investor protections may be limited or unavailable depending on the asset, exchange, broker, wallet provider, product, service provider, and jurisdiction; you may not have access to compensation schemes, deposit insurance, ombudsman services, chargeback rights, or insolvency protection if something goes wrong.

You are solely responsible for understanding the risks of any crypto-asset, digital asset, exchange, broker, wallet, product, market, or strategy that you choose to access, monitor, analyse, or trade through or in connection with Traider Coach.
22. Risk Monitoring, Suggested Levels, and Risk Alert Limitations
Suggested risk levels. During onboarding you are asked to indicate your general trading experience. Based on the broad experience category you select, Traider Coach proposes default Daily Stop and Trade Stop values as a neutral starting point. These suggestions are general defaults associated with broad experience categories. They are not based on, and do not take into account, your personal financial situation, objectives or needs, and they are not a recommendation that any particular level is suitable for you. You choose your own Daily Stop and Trade Stop levels: you are prompted to review and adjust the suggested values during setup, and you can change them at any time in Settings. The levels you use are your own choice and your responsibility.
Traider Coach may provide risk monitoring tools, exposure indicators, account warnings, behavioural prompts, notifications, or Risk Alerts. These features are supplementary tools only and are not a substitute for your own risk management, account monitoring, or trading discipline. Risk Alerts may be delayed, incomplete, inaccurate, unavailable, misconfigured, duplicated, not delivered, or based on incomplete, delayed, incorrect, or unavailable data, and may be affected by your settings, connected exchange or broker data, API availability, market-data availability, software version, device performance, internet connection, Platform availability, or third-party service issues.
Traider Coach does not guarantee that any Risk Alert or Suggested Level will identify all risks, prevent losses, arrive before a loss occurs, provide enough time to act, or reflect your actual financial exposure, account risk, liquidation risk, or personal circumstances. You remain solely responsible for monitoring your own positions, orders, balances, exposure, leverage, margin, liquidation risk, fees, open orders, account restrictions, and overall trading risk. No Risk Alert or Suggested Level should be interpreted as financial advice, trading advice, a trade recommendation, a trading signal, or advice to enter, exit, reduce, increase, hedge, or hold any position, and you should not rely on Risk Alerts or Suggested Levels as your only risk-control system or source of risk management.
23. Market Monitor and Alert Limitations
Traider Coach may provide Market Monitor tools, market alerts, filters, rankings, dashboards, prompts, observations, or notifications that display, analyse, rank, identify, or monitor supported market data, price movement, volatility, liquidity, volume changes, exchange data, broker data, asset conditions, or other market-related information. These outputs may be generated from your settings and/or Traider Coach-generated monitoring logic, internal analytical criteria, models, benchmarks, or automated rules, and may be generated without a specific prompt where supported.
Market Monitor outputs are provided for informational, educational, analytical, and process-review purposes only. They are not financial advice, investment advice, trading advice, trade recommendations, trading signals, financial promotions, personal recommendations, or instructions to buy, sell, hold, enter, exit, increase, reduce, hedge, or avoid any position. Market activity, price movement, volatility, liquidity, rankings, alerts, or filters do not mean that you should trade, that any trade is suitable for you, or that any asset, market, product, exchange, broker, strategy, or opportunity is profitable, actionable, or appropriate for your circumstances.

Strategy Feedback may help you review matters such as consistency, execution discipline, historical behaviour, rule adherence, process alignment, trade review, risk behaviour, and deviations from your defined rules or settings, and may be generated from Traider Coach’s internal analytical frameworks, review criteria, benchmarks, model logic, or pattern-recognition processes.
Strategy Feedback is provided for informational, educational, analytical, and process-review purposes only. It is not financial advice, investment advice, trading advice, a trading signal, a trade recommendation, or a recommendation to adopt, modify, abandon, continue, or rely on any particular trading strategy. Strategy experimentation outputs, historical analysis, backtests, simulations, reports, or examples are hypothetical and dependent on available data, your inputs, assumptions, system settings, market conditions, model logic, and Platform limitations.
No strategy is guaranteed to work. Simulated or backtested conditions may differ materially from live market conditions, including liquidity, spreads, slippage, latency, fees, order-book depth, partial fills, rejected orders, execution speed, exchange outages, market gaps, volatility, order priority, and emotional pressure, and may be affected by data quality, missing or delayed data, incomplete historical data, assumptions, look-ahead bias, survivorship bias, curve fitting, over-optimisation, model limitations, and execution assumptions. Strong simulator, practice, or backtesting performance should not be treated as evidence that you will achieve similar results with real capital or in live markets.

Trading-mindset outputs may be incomplete, inaccurate, delayed, or based on limited Trading Data, inputs, behavioural patterns, assumptions, settings, model logic, or Platform limitations, and should not be treated as definitive statements about your psychology, emotions, behaviour, health, wellbeing, or ability to trade.

They may be incomplete, inaccurate, delayed, unsuitable, misinterpreted, or affected by missing or incorrect data. Traider Coach relies on available data, your inputs and settings, connected exchange or broker data, API availability, market-data sources, system assumptions, model logic, internal analytical criteria, benchmarks, and Third-Party Services to generate Platform Outputs. Data used or displayed may be missing, delayed, duplicated, corrupted, incomplete, inaccurate, outdated, incorrectly labelled, incorrectly interpreted, or unavailable, and Platform Outputs may contain errors or limitations.
No software can perfectly assess trading risk, execution quality, strategy quality, market conditions, behaviour, emotional state, psychological state, account exposure, order status, or future trading outcomes. Traider Coach does not guarantee that any data, Analytics, model output, score, alert, prompt, dashboard, report, Feedback, calculation, or Platform Output will be accurate, complete, current, reliable, timely, suitable, or available. You are responsible for independently verifying important information before making trading, financial, legal, tax, or other decisions, and where appropriate should verify information directly with the relevant exchange, broker, trading venue, wallet, account provider, data provider, or other Third-Party Service.
30. No Guarantee of Results
Traider Coach does not guarantee profits, improved trading performance, reduced losses, better decisions, improved discipline, reduced risk, emotional control, successful strategy development, successful order execution, or any particular trading outcome. Traider Coach does not guarantee that any alert, feedback, Analytics, Risk Alert, Market Monitor output, Strategy Feedback, Suggested Level, simulator result, backtest, education content, or Trading Mindset Module output will prevent mistakes, losses, missed opportunities, liquidation events, overtrading, impulsive trading, failed orders, or poor trading outcomes.
Your results may vary significantly based on many factors, including your experience, knowledge, behaviour, discipline, risk management, capital, strategy, market conditions, asset selection, exchange or broker, order types, leverage, margin, fees, tools, technology, internet connection, emotional state, personal circumstances, and external events. Traider Coach does not determine whether trading, crypto-assets, digital assets, leverage, margin, derivatives, futures, perpetuals, options, any exchange, any broker, any asset, any product, any market, any strategy, any order type, or any Platform feature is suitable, appropriate, advisable, lawful, or beneficial for you. Any Platform Output is not based on a full assessment of your personal circumstances and should not be treated as a personal recommendation.
You are responsible for deciding whether trading and any use of Traider Coach is appropriate for your circumstances, and you should seek independent financial, legal, tax, psychological, medical, or other professional advice where appropriate, especially before trading high-risk products or using leverage, margin, derivatives, futures, perpetuals, options, crypto-assets, or other volatile products.
32. Jurisdictional Restrictions and User Compliance
Traider Coach is offered to individual consumers internationally and is not directed at, or targeted to, any particular country, region, or jurisdiction. It may not be available, appropriate, lawful, or suitable for use in every country, region, or jurisdiction. You are responsible for ensuring that your access to and use of Traider Coach, connected exchanges or brokers, and any relevant assets, products, markets, or strategies is lawful in your jurisdiction, and for complying with all laws, regulations, tax rules, sanctions rules, exchange rules, broker terms, market-conduct rules, reporting obligations, and third-party terms that apply to you and your trading activity.
Traider Coach may restrict, block, suspend, limit, vary, or refuse access to the Platform, Accounts, Trials, Subscriptions, features, exchanges, brokers, assets, products, data sources, integrations, payment methods, or access methods by country, region, jurisdiction, user type, regulatory status, or legal requirement, and certain features may be unavailable, restricted, modified, or subject to additional terms in particular jurisdictions. Where required by applicable law, jurisdiction-specific terms will apply in addition to these Terms and may override these Terms to the extent of any inconsistency.
Traider Coach may require legal, regulatory, privacy, consumer-law, tax, financial-services, crypto-asset, subscription, marketing, or product review before making certain features available in any market. You must not access or use Traider Coach from a country, region, or jurisdiction where such access or use is prohibited or restricted or would cause Traider Coach or you to breach applicable law, and if you become resident in or access Traider Coach from a place where it or particular features are not available or lawful, you must stop using the affected features and notify Traider Coach where appropriate. Access to Traider Coach does not mean that Traider Coach confirms that trading or any feature is lawful, suitable, or appropriate for you.
33. Privacy and Data Protection
Your access to and use of Traider Coach is subject to the Privacy Policy, which explains how Traider Coach collects, uses, stores, protects, shares, transfers, retains, and deletes personal data and other User Data. You should read the Privacy Policy together with these Terms.
Traider Coach may collect, process, generate, or receive data including Account data, registration data, contact details, billing data, Trading Data, connected exchange or broker data, API-related data, market data, behavioural data, mindset-related indicators, the experience information you provide at onboarding, simulator data, education-progress data, analytics data, device data, usage data, diagnostic data, support communications, and other information provided by or relating to you. Depending on the feature, access method, jurisdiction, and applicable law, Traider Coach may process data to provide the Platform, operate Accounts, manage Subscriptions, process payments, provide exchange and broker connections, support order-entry and User-Directed Order Transmission, provide analytics, generate alerts and Suggested Levels, provide education and simulator tools, deliver behavioural insights, improve the Platform, provide support, maintain security, detect misuse, comply with legal obligations, and exercise legal rights.
Where required by applicable law, Traider Coach will identify an appropriate basis for processing personal data, obtain consent where needed, provide collection notices, offer applicable user rights, and allow privacy-related requests in accordance with the Privacy Policy. Where described in the Privacy Policy and permitted by applicable law, Traider Coach may use data to improve, test, maintain, secure, debug, and develop the Platform, and to train, evaluate, improve, or monitor models, algorithms, automated analysis systems, scoring systems, AI-assisted features, or behavioural-insight tools. Traider Coach may generate aggregated, anonymised, or de-identified data, analytics, benchmarks, or insights to the extent described in the Privacy Policy and permitted by applicable law.
Data may be processed by Traider Coach, its affiliates, and the service providers described in the Privacy Policy, and may be transferred to, stored in, or accessed from countries other than the country where you are located, subject to applicable legal requirements. Traider Coach uses reasonable technical, organisational, and security measures designed to protect User Data, but no system can be guaranteed to be completely secure, and Traider Coach does not guarantee absolute security of any data, Account, device, connection, or Platform activity. You are responsible for maintaining the security of your Account, devices, credentials, local environment, connected accounts, email account, and authentication methods. If there is any inconsistency between these Terms and the Privacy Policy regarding personal data, the Privacy Policy applies to the extent of the inconsistency, unless applicable law requires otherwise.
34. Data Export, Deletion, Retention, and Account Closure
Traider Coach may allow you to export certain Account data, Trading Data, reports, Analytics, simulator results, education progress, settings, or other Platform data where export functionality is made available. Available export formats, frequency, limits, fields, historical coverage, and access may vary depending on Subscription tier, Trial status, access method, jurisdiction, technical limitations, connected accounts, data availability, and Platform configuration. Traider Coach does not guarantee that exports, reports, summaries, or downloaded data will be complete, current, accurate, suitable for tax or legal reporting, or available at all times, and you are responsible for maintaining your own records where required.
If you disconnect an exchange, broker, wallet, trading account, or other third-party account, Traider Coach may stop receiving new data from that source; previously imported or generated data may remain in your Account, backups, logs, analytics systems, or support records in accordance with the Privacy Policy, these Terms, and applicable law. After Trial expiry, cancellation, non-payment, downgrade, suspension, termination, or Account closure, you may lose access to some or all Platform features, data, reports, exports, Analytics, alerts, simulator results, education progress, or connected-account data; Traider Coach will give you a reasonable opportunity to export available data before deletion where practicable (see Section 41).
Traider Coach may retain, delete, restrict, archive, anonymise, de-identify, or continue processing data after cancellation, suspension, termination, or Account closure as described in the Privacy Policy and as permitted or required by applicable law, including for legal compliance, dispute resolution, fraud prevention, security, audit, tax, accounting, backup, or enforcement purposes. Deletion of an Account or disconnection of a third-party account may not immediately delete all related data from backups, logs, diagnostics, support records, payment records, legal records, or third-party systems. Where supported or required by law, you may request access, correction, deletion, export, restriction, objection, portability, or other privacy rights as described in the Privacy Policy, subject to legal, technical, security, identity-verification, or operational limitations.
35. Intellectual Property
Traider Coach and its licensors retain all rights, title, and interest in and to the Platform and all related intellectual property, including the Traider Coach software, code, website, web-based platform, downloadable software, desktop applications, dashboards, user interfaces, designs, workflows, Analytics, scoring systems, feedback models, strategy tools, simulator design, education modules, exercises, documentation, trade-review frameworks, behavioural-insight tools, risk models, Market Monitor tools, reports, prompts, content, trademarks, logos, and branding.
Subject to these Terms, your Subscription tier, the EULA where applicable, and any applicable feature restrictions, Traider Coach grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Platform for your own personal use. You must not copy, modify, adapt, translate, distribute, sell, resell, rent, lease, sublicense, publicly display, publicly perform, reproduce, scrape, extract, reverse engineer, decompile, disassemble, create derivative works from, or otherwise exploit any part of Traider Coach, except as expressly permitted by these Terms, the EULA, or applicable law, and you must not use Traider Coach materials, data, Analytics, scoring systems, feedback models, education content, simulator design, strategy tools, trade-review frameworks, dashboards, workflows, prompts, reports, or outputs to build, train, test, benchmark, improve, or commercialise a competing product or service, except where applicable law permits this despite the restriction.
You retain ownership of User Data that you provide to Traider Coach, subject to the rights granted under these Terms and the Privacy Policy. You grant Traider Coach the rights necessary to host, process, analyse, transmit, display, reproduce, modify, adapt, store, and use User Data to provide, operate, secure, support, improve, and develop the Platform. If you provide suggestions, comments, ideas, feature requests, feedback, bug reports, or other input, you grant Traider Coach a perpetual, irrevocable, worldwide, royalty-free right to use, modify, incorporate, commercialise, and otherwise exploit that input without restriction or compensation, subject to applicable law. Traider Coach may generate or use aggregated, anonymised, or de-identified data, analytics, benchmarks, or insights, provided such data is handled in accordance with applicable law and the Privacy Policy. No rights are granted to you except those expressly stated in these Terms or the EULA, and Traider Coach reserves all rights not expressly granted.
36. Platform Availability, Maintenance, Support, and Changes
Traider Coach may be unavailable, interrupted, delayed, degraded, or restricted from time to time, including because of maintenance, updates, outages, technical issues, security issues, third-party failures, exchange or broker API failures, market-data provider issues, internet disruptions, cloud-provider issues, payment-provider issues, or unexpected events. Unless expressly agreed otherwise in writing, Traider Coach does not guarantee any specific uptime, availability level, response time, data refresh rate, alert delivery time, support response time, or error-resolution time.
Any reference to “real-time” or “near real-time” functionality is subject to data availability, exchange or broker connectivity, API performance, system latency, internet connection, device performance, your settings, software version, Platform availability, and third-party service performance. Traider Coach may add, remove, modify, rename, suspend, restrict, replace, or discontinue any feature, module, integration, connection, data source, Subscription tier, access method, support channel, or Platform version where reasonably necessary, subject to Section 47 (including its notice and refund provisions where a material change detrimentally affects a paid feature you rely on), any applicable Subscription obligations, and applicable law.
Traider Coach may provide support through channels made available from time to time, such as email, help desk, chat, knowledge base, support portal, or in-product support; availability, response times, scope, and priority may vary by Subscription tier, region, issue type, and channel. Traider Coach is not required to provide support for unsupported devices, browsers, outdated software versions, unsupported exchanges or brokers, third-party platforms, user-side connectivity or security issues, unauthorised modifications, or uses of Traider Coach that violate these Terms or the EULA. Platform changes, outages, delays, discontinued features, or support limitations do not affect your responsibility for your own trading decisions, account monitoring, risk management, and losses, and do not limit your rights under Section 14 or applicable law.
37. Beta Features and Experimental Tools
Traider Coach is currently provided in beta to individual consumers, and particular features, modules, integrations, tools, models, alerts, or Analytics may also be made available in pilot, experimental, preview, early-access, or test form. Beta and experimental functionality may be incomplete, unstable, inaccurate, delayed, unavailable, unsupported, or subject to change, may contain errors or produce incorrect outputs, and may be removed, suspended, restricted, or modified, subject to Section 47 and applicable law.
You should not rely on beta or experimental functionality for trading decisions, risk management, account monitoring, strategy selection, market analysis, legal compliance, tax compliance, or any other important decision. During the beta period, Traider Coach may limit access, restrict functionality, change feature behaviour, modify supported exchanges or brokers, change data sources, adjust alert logic, require updates, change user interfaces, reset test environments, or discontinue beta functionality, subject to Section 47 and applicable law. Beta data, settings, configurations, alerts, reports, simulator results, strategy experiments, education progress, behavioural insights, or other beta-related data may be reset, deleted, modified, unavailable, or not migrated to later versions, and you should not rely on beta data as your sole record of trading activity, risk management, account activity, or Platform use.
Unless expressly stated otherwise, beta access does not change the Subscription, Trial, billing, cancellation, renewal, refund, risk-disclosure, no-financial-advice, user-responsibility, limitation-of-liability, consumer-guarantee, or other terms that apply to your Account. Beta access may be limited to selected Users, regions, exchanges, brokers, features, access methods, Subscription tiers, or technical environments, and Traider Coach may approve, refuse, restrict, suspend, or end beta access where reasonably necessary, subject to Section 41 and applicable law. Traider Coach may use beta feedback, bug reports, usage observations, support requests, product suggestions, and diagnostic information to test, improve, secure, and develop the Platform, subject to the Privacy Policy and applicable law. Nothing in this section excludes, restricts, or modifies any consumer guarantee, statutory right, refund right, warranty, remedy, or other legal protection that cannot lawfully be excluded. Traider Coach may require you to confirm a beta-specific acknowledgement at appropriate points in the user journey.
38. Disclaimers of Warranties
This section is subject to Section 14 and to your rights under the Australian Consumer Law and the ASIC Act. Nothing in this section excludes, restricts, or modifies any consumer guarantee, warranty, condition, right, or remedy that cannot lawfully be excluded, restricted, or modified, and nothing in this section excludes or limits liability for misleading or deceptive conduct. If you are a consumer, the consumer guarantees described in Section 14 apply to you despite anything in this section.
Subject to the paragraph above, and to the maximum extent permitted by applicable law, Traider Coach is provided on an “as is” and “as available” basis. To that extent, Traider Coach does not warrant or guarantee that the Platform, any feature, access method, integration, connection, API connection, Platform Output, or Third-Party Service will be accurate, complete, current, reliable, secure, uninterrupted, error-free, timely, suitable, or available, and disclaims warranties and conditions of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, compatibility, security, data integrity, and performance, except to the extent such warranties or conditions cannot lawfully be excluded.
To the maximum extent permitted by applicable law, Traider Coach does not warrant that alerts will be delivered, Analytics will be accurate, connections will work continuously, order instructions will be transmitted, received, or executed without delay or error, simulator or backtesting results will match live-market results, education or mindset features will improve performance, or the Platform will be compatible with all devices, systems, networks, exchanges, brokers, data providers, or Third-Party Services. No oral or written statement, marketing material, support response, website content, app-store description, help article, demonstration, example, screenshot, or testimonial from Traider Coach creates any warranty or guarantee beyond those expressly stated in writing by an authorised representative; however, this does not exclude or limit liability for misleading or deceptive conduct or for breach of any non-excludable statutory guarantee.
39. Limitation of Liability
This section is subject to the following limits, which apply before any other part of this section. Nothing in these Terms excludes, restricts, or limits liability that cannot lawfully be excluded, restricted, or limited, including liability for fraud or wilful misconduct, liability for death or personal injury caused by negligence, liability for misleading or deceptive conduct, and liability for breach of the consumer guarantees described in Section 14. If you are a consumer and Traider Coach breaches a consumer guarantee that cannot be excluded, your rights and remedies under the Australian Consumer Law or the ASIC Act apply, and where the relevant law permits Traider Coach to limit its liability for that breach, Traider Coach limits it to supplying the services again or paying the cost of having the services supplied again.
Subject to the paragraph above, and to the maximum extent permitted by applicable law, Traider Coach and its affiliates, officers, employees, contractors, agents, licensors, and service providers will not be liable for trading losses, missed trading opportunities, loss of profits or anticipated gains, liquidation or margin losses, losses exceeding account balances, losses arising from reliance on Platform Outputs, Third-Party Provider failures, data errors, downtime, cybersecurity incidents not caused by Traider Coach’s breach or negligence, unauthorised access not caused by Traider Coach’s breach or negligence, local device compromise, loss or unavailability of data, tax or regulatory consequences, or indirect, incidental, special, consequential, exemplary, or punitive damages.
Subject to the first paragraph of this section, and to the maximum extent permitted by applicable law, Traider Coach’s total aggregate liability arising out of or relating to these Terms, the Platform, any Subscription, any Trial, any access method, or any Platform Output will not exceed the total amount of Subscription fees actually paid by you to Traider Coach (in United States dollars) during the twelve months immediately before the event giving rise to the claim. This cap does not apply to any liability described in the first paragraph of this section. Where applicable law does not allow a particular exclusion or cap, Traider Coach’s liability is limited to the maximum extent permitted by that law.
40. Indemnity
To the maximum extent permitted by applicable law, you agree to indemnify Traider Coach and its affiliates, officers, employees, contractors, agents, licensors, and service providers against claims, losses, damages, liabilities, penalties, fines, costs, and reasonable legal fees to the extent they are caused by: your breach of these Terms or the EULA; your fraud, wilful misconduct, or unlawful, unauthorised, abusive, manipulative, or prohibited activity; your breach of third-party terms or market-conduct rules; your infringement of third-party rights; your unauthorised use of accounts or credentials; or your failure to maintain account or device security.
This indemnity does not apply to the extent the relevant claim, loss, or liability is caused by Traider Coach’s own breach of these Terms, negligence, or wilful misconduct. If you are a consumer, you are liable under this indemnity only for loss caused by your own wrongful act or omission, and only to the extent that loss is not caused by Traider Coach, and nothing in this section limits or excludes any right or protection you have under the Australian Consumer Law, the ASIC Act, or other law that cannot lawfully be excluded.
Traider Coach may control the defence and settlement of any claim covered by this section, subject to applicable law, and you agree to cooperate reasonably. You must not settle any claim in a way that imposes liability, obligation, admission, or restriction on Traider Coach without Traider Coach’s prior written consent. This indemnity survives termination, cancellation, suspension, Account closure, and expiry of these Terms.
41. Suspension and Termination
Traider Coach may suspend, restrict, disable, or terminate access to your Account, Subscription, Trial, Platform features, connections, API connections, data, integrations, or support in accordance with this section. Traider Coach will use the least restrictive measure reasonably available in the circumstances, and will restore access once the relevant issue is resolved where it is reasonable to do so.
Serious grounds. Where Traider Coach reasonably believes it is necessary to address non-payment after a reasonable opportunity to pay, suspected fraud, market abuse, unlawful activity, sanctions or financial-crime risk, suspected unauthorised access or account or credential compromise, API abuse, a security risk, use from a prohibited or restricted jurisdiction, access by or on behalf of a Restricted Public-Sector Body without written approval, a material breach of these Terms, or a legal, regulatory, or third-party requirement, Traider Coach may suspend, restrict, or terminate access immediately and, where reasonably necessary, without advance notice. Traider Coach will give you notice as soon as reasonably practicable, unless prohibited by law.
Other changes (termination for convenience). Where Traider Coach suspends, restricts, or terminates your access for reasons other than the serious grounds above or your breach or fault, including the discontinuation or unavailability of a relevant feature, integration, connection, data source, access method, or Subscription tier, Traider Coach will give you reasonable prior notice and will provide a pro-rata refund of any pre-paid fees for the unused part of your current billing period.
You may cancel your Subscription at any time using the self-service method described in Section 13.5. Cancellation affects future billing; refunds for the current billing period are dealt with in Sections 13.6 and 14 and applicable law. After cancellation, suspension, termination, non-payment, Trial expiry, downgrade, or Account closure, you may lose access to some or all Platform features and content, and Traider Coach will give you a reasonable opportunity to export available data before deletion where practicable. You remain responsible for disconnecting connected accounts, API connections, access tokens, and permissions directly with the relevant third party where appropriate. Termination, suspension, cancellation, or Account closure does not affect any fees, charges, taxes, liabilities, obligations, claims, or rights that accrued before its effective date. Survival of key provisions is addressed in Section 48.8.
42. Tax Responsibility and No Tax Advice
Traider Coach does not provide tax advice, accounting advice, legal advice, financial advice, or regulatory advice. You are solely responsible for your own tax reporting, recordkeeping, filing obligations, payment obligations, and compliance obligations in all relevant jurisdictions.
Any reports, exports, summaries, dashboards, Analytics, trading records, transaction history, account data, simulator data, or other information generated, imported, displayed, or exported through Traider Coach may be incomplete, inaccurate, delayed, duplicated, missing, or incorrectly categorised, and may be unsuitable for tax, accounting, audit, legal, or regulatory reporting without independent verification. You are responsible for maintaining your own records and verifying any information you use for tax, accounting, legal, audit, or reporting purposes, including directly with the relevant exchange, broker, wallet provider, trading venue, payment provider, bank, accountant, or tax adviser. Traider Coach does not determine your tax residency, status, taxable events, cost basis, gains, losses, income, deductions, reporting obligations, filing deadlines, or tax treatment of any activity, and you should seek advice from a qualified professional where required.
43. Marketing Claims, Testimonials, Affiliates, and Promotional Materials
Marketing materials, testimonials, case studies, reviews, examples, screenshots, demonstrations, affiliate statements, influencer content, referral materials, website copy, app-store descriptions, onboarding content, emails, and advertisements relating to Traider Coach are provided for general informational and promotional purposes only. No such material should be interpreted as a guarantee of profit, improved performance, reduced losses, better discipline, emotional control, trading success, successful strategy development, or any particular result, and must describe only features that are currently available.
Testimonials, reviews, examples, case studies, or user stories reflect individual experiences only and do not represent typical results, expected results, forecasts, promises, or guarantees. All marketing claims should be read together with these Terms and the Risk Disclosure & No Financial Advice Notice and do not override the no-financial-advice, no-guarantee, trading-risk, user-responsibility, consumer-guarantee, or limitation-of-liability provisions in these Terms, and nothing in any marketing material limits your rights under the Australian Consumer Law or the ASIC Act.
If Traider Coach uses affiliates, ambassadors, referral partners, creators, influencers, or introducers, those persons must not make unauthorised claims, guarantees, trading signals, financial advice, investment advice, trade recommendations, performance promises, or statements inconsistent with Traider Coach’s approved claims and risk disclosures, must follow approved language, and must disclose their relationship with Traider Coach where required. Traider Coach may remove, correct, qualify, reject, report, or disavow any unauthorised, misleading, exaggerated, non-compliant, or inconsistent promotional claim, testimonial, review, or advertisement relating to Traider Coach. Nothing in any marketing or promotional material creates any warranty, professional-advice relationship, fiduciary relationship, brokerage relationship, or obligation unless expressly stated in writing by an authorised representative of Traider Coach.
44. Third-Party Services, App Stores, and Payment Processors
Traider Coach may rely on third-party services to provide, operate, secure, support, process, analyse, host, deliver, or improve the Platform, including exchanges, brokers, trading venues, wallet providers, market-data providers, payment processors, banks, app stores, cloud providers, hosting providers, analytics providers, identity providers, communications providers, support tools, security providers, software libraries, and API providers.
Your use of Traider Coach may be affected by third-party terms, privacy policies, fees, limits, availability, outages, delays, errors, account restrictions, refund processes, technical requirements, or service changes, and you are responsible for reviewing and complying with any third-party terms that apply to your use of those services. If you purchase a Subscription through an app store or payment processor, billing, renewal, cancellation, refund, tax, chargeback, and support processes may be controlled partly or entirely by that third party, whose terms may apply in addition to these Terms.
To the extent not caused by Traider Coach’s breach of these Terms or negligence, Traider Coach is not responsible for third-party service failures, outages, data errors, delays, restrictions, fees, payment failures, refund limitations, app-store restrictions, account suspensions, API issues, security incidents, or service changes. Nothing in this section limits liability that cannot be excluded under applicable law. Support for, connection to, or integration with any third-party service does not mean that Traider Coach recommends, endorses, controls, verifies, guarantees, or accepts responsibility for it.
45. Electronic Communications and Notices
By creating an Account, accessing or using Traider Coach, starting a Trial, purchasing a Subscription, connecting an exchange or broker, or otherwise using the Platform, you consent to receive notices and communications from Traider Coach electronically, including Account, service, security, billing, payment, renewal, cancellation, Trial, legal, policy-update, risk-disclosure, feature, and support communications. Traider Coach may provide notices by email, in-app message, dashboard notice, Account notification, website posting, software notification, support message, billing portal message, or another reasonable electronic method.
You are responsible for keeping your Account contact information current and accurate. For routine administrative and service notices, notices sent by email are treated as received when sent, and notices posted in the Platform, on the website, or through in-app, dashboard, Account, billing-portal, or software notifications are treated as received when made available. However, for billing notices, renewal notices, trial-expiry notices, price-increase notices, and any notice of a change that is materially detrimental to you, Traider Coach will take reasonable steps to ensure you actually receive the notice, and such a notice is treated as given only when it has been delivered to you (for example, sent to your current email address and not returned as undeliverable) or otherwise actually brought to your attention. To the extent a charge or detrimental change depends on such a notice, it will not take effect unless the notice has been effectively given.
Legal notices to Traider Coach must be sent by email to [email protected] and, where required, by post to Traider Coach Pty Ltd, Tower 3 International Towers, Level 38, 300 Barangaroo Avenue, Sydney, New South Wales 2000, Australia. Transactional, administrative, legal, security, billing, service, and account-related communications are not marketing communications and may be sent even if you have opted out of marketing, to the extent permitted by applicable law. Marketing emails, promotional communications, or newsletters may require separate consent or opt-out under applicable privacy, spam, electronic-marketing, or consumer-protection laws.
46. Complaints, Disputes, Governing Law, and Jurisdiction
If you have a complaint or dispute relating to Traider Coach, you should first contact Traider Coach at [email protected] or using any support or complaints channel made available. Complaints should include enough information to allow Traider Coach to assess the issue, including your Account details, the relevant feature, transaction, Subscription, support interaction, date, and a description of the issue. Traider Coach will use reasonable efforts to review complaints submitted through the proper channel but does not guarantee a particular outcome, remedy, or resolution time unless required by applicable law.
These Terms and any dispute, claim, or controversy arising out of or relating to Traider Coach, the Platform, your Account, your Subscription, any Trial, any connected account, any Platform Output, or these Terms are governed by the laws of New South Wales, Australia, without regard to its conflict-of-laws rules, and the courts of New South Wales (and courts competent to hear appeals from them) have jurisdiction, except where applicable consumer law gives you a right to bring proceedings, or requires proceedings to be brought, elsewhere.
If you are a consumer, the following do not apply to you, and nothing in these Terms deprives you of any mandatory consumer protection, statutory limitation period, forum right, governing-law protection, statutory guarantee, or other legal right that cannot lawfully be excluded or restricted: any class-action waiver; any jury-trial waiver; and any provision purporting to shorten the time within which you may bring a claim below the period allowed by law. Nothing in these Terms limits your right to bring a complaint to a regulator, consumer-protection authority, data-protection authority, court, tribunal, ombudsman, or other body where applicable law gives you that right.
Traider Coach may seek injunctive, equitable, or urgent relief in any court of competent jurisdiction where necessary to protect its intellectual property, confidential information, Platform security, Users, systems, data, business operations, or legal rights.
47. Changes to These Terms
Traider Coach may update, modify, replace, or supplement these Terms from time to time, for reasons including product updates, new features, changed access methods, new Subscription plans, changes to integrations, legal or regulatory developments, security requirements, operational changes, or updates to related policies. Changes will be made in accordance with this section and applicable law.
Minor or non-material changes. For changes that do not materially affect your rights or obligations, Traider Coach will make the updated Terms available and update the “last updated” date, and your continued use of Traider Coach after the updated Terms take effect will constitute acceptance of those non-material changes.
Material or detrimental changes. For changes that are material or detrimental to you, including a price increase, the removal or material reduction of a paid feature you rely on, or a material change to your rights or obligations, Traider Coach will give you at least 30 days’ advance notice using a method reasonably likely to reach you (and consistent with Section 45). You may cancel your Subscription before the change takes effect, and if you do, or if Traider Coach otherwise ends your access because you do not accept the change, Traider Coach will provide a pro-rata refund of any pre-paid fees for the unused part of your current billing period. Where required by law or where the change is significant, Traider Coach may ask you to actively accept the updated Terms before you continue to use the affected part of the Platform; a material change will not be imposed on you by continued use alone.
Updated Terms take effect on the date stated in the notice or, if no date is stated, when they are made available, subject to the notice and acceptance requirements above. If you do not agree to updated Terms, you must stop using Traider Coach and, where applicable, cancel your Subscription before the updated Terms take effect; any cancellation, refund, withdrawal, or objection rights will be handled in accordance with applicable law, these Terms, and any jurisdiction-specific terms. Changes to related policies, including the Privacy Policy, Cookie Policy, Risk Disclosure & No Financial Advice Notice, EULA, or feature-specific terms, may be handled under the update provisions in those documents or under this section where applicable. Nothing in this section limits any right you have under the Australian Consumer Law or the ASIC Act.
48. General Legal Terms
48.1 Force Majeure
Traider Coach will not be responsible for any failure or delay in performing its obligations where the failure or delay is caused by events beyond its reasonable control, including natural disasters, extreme weather, fire, flood, war, terrorism, civil unrest, labour disputes, government action, legal or regulatory changes, sanctions, power failures, internet failures, cloud-provider failures, exchange or broker failures, market-data provider failures, cyber incidents, payment-provider failures, app-store issues, or telecommunications failures. This clause does not limit any right or remedy you have under the Australian Consumer Law or the ASIC Act.
48.2 Assignment
You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms without Traider Coach’s prior written consent. Traider Coach may assign, transfer, delegate, subcontract, or otherwise deal with its rights or obligations in connection with a merger, acquisition, reorganisation, sale of assets, corporate restructuring, change of control, financing, or outsourcing, provided that your rights under these Terms and applicable law are not materially reduced as a result.
48.3 Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted, modified, or severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
48.4 Waiver
A failure or delay by Traider Coach to enforce any provision of these Terms does not constitute a waiver of that provision or any other right. Any waiver must be in writing and applies only to the specific matter for which it is given.
48.5 Entire Agreement
These Terms, together with the documents incorporated by reference (including the Privacy Policy, Cookie Policy, Risk Disclosure & No Financial Advice Notice, EULA where applicable, Subscription terms, jurisdiction-specific addenda, and feature-specific terms), form the entire agreement between you and Traider Coach regarding your access to and use of the Platform and supersede prior or contemporaneous understandings relating to the Platform, except where a separate written agreement signed by Traider Coach expressly states otherwise. Nothing in this clause excludes or limits any liability or right arising from misleading or deceptive conduct, or any non-excludable statutory guarantee or right under the Australian Consumer Law or the ASIC Act, and you are not prevented from relying on any representation that the law does not allow to be excluded by an entire-agreement clause.
48.6 No Third-Party Beneficiaries
Except where these Terms expressly state otherwise, these Terms do not create rights for any person or entity who is not a party to them.
48.7 Relationship of the Parties
Nothing in these Terms creates any partnership, joint venture, employment, agency, fiduciary, advisory, brokerage, portfolio-management, custody, trustee, or representative relationship between you and Traider Coach. You and Traider Coach are independent parties.
48.8 Survival
Any provision that by its nature should survive termination, cancellation, suspension, Account closure, or expiry of these Terms will survive, including provisions relating to no financial advice, trading risk, user responsibility, no guarantees, intellectual property, data and privacy, payment obligations, disclaimers, limitation of liability, indemnity, consumer guarantees, dispute resolution, governing law, and general legal terms.
48.9 Language Versions
If Traider Coach provides these Terms in more than one language, the English-language version will control to the extent of any inconsistency, unless applicable law requires otherwise or a jurisdiction-specific version expressly states otherwise.

49. Jurisdiction-Specific Addenda and Regional Notices
These Terms are written as global terms and are not directed at, or targeted to, any particular country or region. As Traider Coach opens or targets specific markets, it may provide jurisdiction-specific addenda, regional notices, product disclosures, risk warnings, consumer-rights notices, privacy notices, subscription terms, marketing disclosures, or other local-law terms for those markets. Such addenda may address matters including local regulatory status; crypto-asset and digital-asset regulation; exchange, broker, wallet, API, market-data, and third-party integrations; consumer rights, cooling-off rights, withdrawal rights, cancellation rights, and refund rights; recurring billing, automatic renewal, renewal reminders, cancellation methods, and subscription disclosures; privacy and data-protection rights, profiling, automated analysis, AI-assisted features, and international data transfers; marketing and disclosure requirements; language, accessibility, complaint, and regulator-information requirements; restrictions on particular assets, products, exchanges, brokers, features, data sources, payment methods, access methods, or Subscription tiers; and liability, warranty, indemnity, governing-law, and dispute-resolution terms that may differ between jurisdictions.
Traider Coach may, in the future, target or open specific markets, which may require different terms, disclosures, warnings, restrictions, registrations, notices, language versions, product configurations, or acknowledgements before Traider Coach is made available there. Traider Coach may restrict, modify, suspend, block, or vary access to any feature, exchange, broker, asset, product, data source, Subscription tier, Trial, payment method, access method, or integration by jurisdiction where reasonably necessary for legal, regulatory, tax, consumer-protection, privacy, financial-crime, sanctions, or operational reasons.
If a jurisdiction-specific addendum, regional notice, mandatory legal right, or local-law requirement conflicts with these Terms, the jurisdiction-specific addendum, regional notice, mandatory legal right, or local-law requirement applies to the extent required by applicable law. If Traider Coach provides translated regional notices, the language-priority rule in Section 48.9 applies unless applicable law requires otherwise. Access to Traider Coach in a particular jurisdiction does not mean that Traider Coach confirms that the Platform, any feature, any connected exchange or broker, any asset, any product, any market, or any trading activity is lawful, suitable, appropriate, or available for you there, and you remain responsible for complying with all laws and requirements that apply to your use of Traider Coach and your trading activity.
50. User Acknowledgement
By creating an Account, accessing or using Traider Coach, starting a Trial, purchasing or renewing a Subscription, connecting an exchange or broker, or using any Platform feature, you acknowledge and agree that: (a) you have read, understood, and accepted these Terms; (b) you have read and understood the Risk Disclosure & No Financial Advice Notice, the Privacy Policy, the EULA where applicable, and any jurisdiction-specific notices or feature-specific warnings presented to you; (c) Traider Coach does not provide financial advice, investment advice, trading advice, trade recommendations, trading signals, personal recommendations, portfolio management, discretionary account management, brokerage, custody, fiduciary services, tax advice, legal advice, psychological advice, medical advice, or therapeutic services; (d) Traider Coach does not recommend any Trading Action, and any Suggested Levels or default settings are general defaults that you choose and can change, and are not a personal recommendation; (e) trading involves substantial risk and you may lose some or all of your capital; (f) where leverage, margin, derivatives, futures, perpetuals, options, crypto-assets, digital assets, or other volatile products are used, losses may be amplified and may exceed your initial deposit, collateral, margin, or account balance; (g) Platform Outputs may be incomplete, inaccurate, delayed, unavailable, misconfigured, or unsuitable for your circumstances; (h) Traider Coach does not guarantee profits, improved performance, reduced losses, better decision-making, improved discipline, reduced risk, emotional control, successful strategy development, or any particular result; (i) you remain solely responsible for all trading decisions, trading outcomes, risk management, account activity, connected-account activity, legal compliance, tax compliance, and losses; (j) you should not rely on Traider Coach as your sole source of market data, risk management, order monitoring, account monitoring, strategy review, trading discipline, or decision support; (k) you are responsible for ensuring that your access to and use of Traider Coach, any connected exchange or broker, and any trading activity is lawful in your jurisdiction; (l) you should seek independent financial, legal, tax, psychological, medical, or other professional advice where appropriate; (m) Traider Coach is currently provided as a beta version available only through the downloadable desktop application (the web-based platform is not available during the beta), that order-entry functionality and User-Directed Order Transmission are available and that when you use them you create the order and the desktop application sends it directly from your device to the venue you select, Traider Coach’s servers are not part of the order path and it does not select the venue, route, or execute the order, that connections use trade and read permissions only and never withdrawal or transfer permissions and Traider Coach does not store your trade-enabled API keys or take custody of your funds or assets, and that beta functionality and beta data may be incomplete, unstable, inaccurate, delayed, interrupted, unavailable, changed, restricted, reset, deleted, modified, discontinued, or not migrated to later versions; and (n) nothing you acknowledge here excludes, restricts, or modifies any consumer guarantee or other right you have under the Australian Consumer Law or the ASIC Act that cannot lawfully be excluded.
Traider Coach may require you to confirm this acknowledgement during onboarding, before starting a Trial or Subscription, before connecting an exchange or broker, before using particular features, before accessing or continuing to use beta functionality, or at any other point where Traider Coach considers an acknowledgement appropriate.
